Design
The Government Decision 907 of November 29, 2016 regarding the stages of development and the framework-content of the technical-economic documentations related to the investments financed from public funds regulates the development stages and the framework-content of the technical-economic documentations necessary for investments in constructions, interventions on existing constructions and other investment works whose expenses, meant to be used for fixed assets from the public and/or private domain of the State/administrative-territorial unit, or from the private domain of natural and/or legal persons, are entirely or partly financed from public funds.
The documentations are developed by stages as follows:
a) Stage I:
(i) conceptual note;
(ii) design theme;
b) Stage II:
(i) pre-feasibility study, as applicable,
(ii) feasibility study or documentation for approval of intervention works, as applicable;
c) Stage III:
(i) design for authorization/removal of works;
d) Stage IV:
(i) technical execution design.
Conceptual Note and Design Theme
A Conceptual Note is the documentation developed by the Beneficiary of an investment, in order to justify the necessity and opportunity of an investment, financed entirely or partly from public funds. The conceptual note highlights the preliminary data necessary for implementing the intended investment, and it presents information regarding the estimated supportability of the public investment. The framework-content of a conceptual note is indicated in Annex 1 to GD 907/2016.
A Design Theme presents the intentions to invest and the functional needs of the Beneficiary of the investment, highlighted in the conceptual note, establishing the concept of implementing the investment, in relation to the technical, general urban conditions of the location, protection of environment and cultural patrimony, or other conditions specific to the investment.
The design theme is developed by the Beneficiary of the investment or, as applicable, by designers/consultants who provide design/consulting services and it is approved by the Beneficiary. The content of the design theme is indicated in Annex 2 to GD 907/2016 and it is adapted by the Beneficiary, in relation to the specific/category and class of importance, as well as to the complexity of the intended investment.
Technical-economic documentations for investments financed from public funds
The technical-economic documentations are developed by design stages as follows:
a) in case of new investments:
(i) pre-feasibility study, as applicable;
(ii) feasibility study;
(iii) design for authorization/removal of works;
(iv) technical execution design;
b) in case of interventions on existing constructions:
(i) documentation for approval of intervention works;
(ii) design for authorization/removal of works;
(iii) technical execution design;
c) in case of mixed investments:
(i) pre-feasibility study, as applicable;
(ii) feasibility study, completed with specific issues from the documentation for approval of intervention works;
(iii) design for authorization/removal of works;
(iv) technical execution design.
Development of the pre-feasibility study, as applicable, of the feasibility study or of the documentation for approval of intervention works is conditioned by the previous approval of the conceptual note and of the design theme by the Beneficiary of the investment.
The technical-economic documentations are developed by economic operators or authorized freelancers who provide design services.
Development of the technical execution design is conditioned by the previous approval of the technical-economic indicators and by the release of the building/removal permit.
